TIRIO / LEGAL

Terms of Use

Last updated

These terms apply to the website at tirio.io, the swap and trade app on it and the public API at api.tirio.io (together, the "Service"), provided by Tirio Labs ("Tirio", "we", "us"). By using the Service you accept these terms. If you do not accept them, do not use the Service.

1. What the Service is

Tirio is a DEX aggregator. The Service finds routes across third-party liquidity pools, builds transactions for the Tirio smart contracts on BNB Chain and shows them to you. You sign and send every transaction with your own wallet.

  • Non-custodial. Tirio never holds your private keys and never has control of the assets in your wallet. A swap settles in a single transaction from your wallet. An open order's tokens are held by the Orders smart contract under the rules of its code until the order fills, expires or you cancel it.
  • Public beta. The Service is in public beta. It runs on a single server, reads the chain through free public RPC endpoints and has no service level agreement and no status page. It can be slow, unavailable or wrong.
  • No audit. The Tirio smart contracts have not been audited by a third party.
  • Transactions are final. A transaction confirmed on the blockchain cannot be reversed by Tirio or anyone else.

2. Fees

The fees in effect are shown before you sign. Today they are:

  • Tirio fee: 3 bps (0.03 %) of every swap made in the app on tirio.io, taken from the token you pay.
  • Partner links: a link with a partner fee replaces the Tirio fee with the partner's fee. The Router contract keeps 10 % of any partner fee; the contract owner can raise that share to at most 20 %.
  • API: quotes requested from the API directly carry no Tirio fee unless you add a partner fee.
  • Positive slippage: on every exact-in swap whose output token has no transfer tax, if the swap delivers more than the quoted output, Tirio keeps the excess up to 1 % of the quoted output (with a partner, 20 % of what is kept goes to the partner) and the rest reaches you. If the swap delivers less than the quote, you receive less, down to the minimum you accepted. This applies to swaps through the app and through the API.
  • Orders: 10 bps (0.10 %) of what each fill receives, 3 bps between stablecoins.
  • Third-party costs: you also pay network gas and the fees of the pools on your route.

The Router's protocol fee is 0 today. The contract owner can change it up to 100 bps, and the shares above within the contract's limits, at any time and without notice. A change never applies to a transaction already confirmed.

3. Who may use the Service

You may use the Service only if:

  • you are of legal age and able to enter into a binding agreement where you live;
  • you are not the subject of economic sanctions and you are not located in, resident in or organised under the laws of a country or territory subject to comprehensive sanctions or embargoes;
  • using the Service is lawful for you where you are.

You are responsible for complying with the laws that apply to you, including laws on digital assets, securities, sanctions and tax. We may restrict or block access to the Service, or to any part of it, for anyone and at any time, including where we believe the law requires it.

4. Your responsibilities

  • Check every transaction before you sign it: the contract it targets, the tokens, the amount, the minimum received or maximum paid, the deadline and any approval or signature.
  • Check token addresses yourself, especially for tokens you paste. Anyone can deploy a token with any name.
  • Keep your wallet, keys and devices secure. Tirio cannot recover lost keys or reverse transactions.
  • Choose your slippage, order prices and order floors with care. They are the worst outcome the contracts will accept on your behalf.

5. Prohibited use

You must not use the Service to break any law, including laws on sanctions, money laundering, terrorist financing or market manipulation; to trade assets you do not have the right to trade; to attack, overload, scrape beyond the published rate limits or otherwise interfere with the Service; or to impersonate Tirio or mislead others about your relationship with it.

6. Third parties

Routes run through pools, market makers, launchpads and other protocols that Tirio does not operate. Wallets, WalletConnect, RPC endpoints, block explorers, market data providers and token logo hosts are also run by third parties. Tirio does not control them and is not responsible for their behaviour, availability or terms.

7. No advice

Nothing on the Service is investment, financial, legal or tax advice, or a recommendation to trade any asset. Prices, charts, market data, quotes and routes are information only. Listing a token in the app or reaching it through a route says nothing about its quality or legitimacy.

8. No warranty

The Service, the API and the smart contracts are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability and non-infringement. Tirio does not promise the best price, a route for every pair, a quote that holds until your transaction is mined, or that the Service will be free of errors, bugs or interruptions. The risks are described in the Risk Disclosure.

9. Limitation of liability

To the fullest extent permitted by law, Tirio and the people who build it are not liable for any loss of assets, profits, data or opportunity, or for any indirect, incidental, special, consequential or punitive damages, arising from your use of or inability to use the Service or the smart contracts, from transactions you sign, from third-party protocols or services, or from the actions of others on the blockchain, even if advised of the possibility. Where liability cannot be excluded, it is limited to the fees you paid to Tirio for the transaction that caused the claim.

10. Indemnity

You agree to compensate Tirio for claims, losses and costs arising from your breach of these terms or of the law in your use of the Service.

11. Changes and termination

We may change the Service, these terms, the fees within the contracts' limits or the supported tokens and venues at any time. The date at the top of this page shows the latest version; using the Service after a change means you accept it. We may suspend or end the Service, or your access to it, at any time. The smart contracts keep running on the blockchain independently of the website and the API.

12. Contact

Contact Tirio through the channels listed on this site. See also the Privacy Policy and the Risk Disclosure.
